1. Online Store Terms

You must be at least the age of majority where you live to place an order or enter into a binding agreement with us. A parent or legal guardian may supervise a minor’s use of the Site and is responsible for purchases they authorize.

You may use our Site and products only for lawful purposes. You must not introduce malicious code, interfere with the Site, or violate the rights of others.

2. General Conditions

We may restrict access to the Site or decline service for legitimate business, security, fraud-prevention, or legal reasons, subject to applicable law. These rights do not permit unlawful discrimination or eliminate obligations relating to orders we have already accepted.

Unless we authorize it in writing or applicable law permits it, you may not copy, reproduce, sell, or commercially exploit our Site, photography, product designs, graphics, logos, or other protected content. Rights in university names, logos, and other licensed material belong to their respective owners.

Payment information is handled by our payment service providers. Please do not send complete payment card numbers or other sensitive payment credentials by ordinary email.

3. Product and Website Information

We aim to provide accurate product descriptions, prices, availability, and other information. Product colors and details may appear differently depending on your screen and lighting. Images and customization previews illustrate the product; they do not override the product description or any express promises we make.

We may correct errors and update information. If an error materially affects an order you have placed, we will contact you to explain the issue and any available options. Any cancellation and refund will be handled in accordance with applicable law.

4. Prices, Promotions, and Availability

Unless stated otherwise, prices on our Site are in U.S. dollars. Applicable taxes and shipping charges are displayed during checkout. Retail and approved wholesale pricing may differ.

Prices and product availability may change for future purchases. A later price change does not change the agreed price of an accepted order. Sale prices, discount codes, gifts with purchase, and other promotions are subject to the eligibility requirements, exclusions, dates, and other terms disclosed for that promotion.

We may limit quantities or discontinue products. If we cannot fulfill an item you ordered, we will notify you and refund amounts paid for the unfulfilled item as required by law.

5. Products, Preorders, Custom Orders, and Returns

Returns and exchanges

Return eligibility, deadlines, item-condition requirements, exclusions, and the return process are explained in our Returns & Exchanges Policy. Review that policy and any item-specific disclosures before purchasing. Nothing in these Terms or our return policy limits remedies available under applicable law for defective, damaged, incorrect, or misdescribed goods.

Preorders

Items identified as preorders are not available for immediate shipment. Review the shipping estimate and any payment or cancellation terms disclosed on the product page or during ordering. Shipment estimates are different from delivery dates and are not a promise of arrival for a particular game, holiday, or event unless we expressly agree otherwise.

If we cannot ship within the applicable promised timeframe, we will provide required delay notices and cancellation or refund options, obtain consent to a delay where required, and issue refunds as required by applicable law. These Terms do not waive those rights.

Customized products

For customizable patch apparel and other personalized items, review your selected garment, size, design, patches, and placement before submitting your order. Production is based on the selections submitted with your order, subject to the customization options and restrictions disclosed on the product page.

Customization previews are illustrative; appearance may vary with garment size, materials, and production methods. This does not excuse a material departure from the agreed design or a product defect. Any restrictions on returns, cancellations, or design changes must be disclosed before purchase. Contact us promptly if you need to request a change; we cannot guarantee changes once production has begun.

Wholesale purchases

Approved wholesale purchases may be subject to separate order minimums, pricing, deposits, payment terms, shipment schedules, cancellation terms, and return terms disclosed and agreed to when the order is placed. Those agreed wholesale terms control the corresponding matters for that order if they conflict with general retail terms. Purchases through Faire are also subject to the applicable terms of that platform.

6. Orders, Payments, and Account Information

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt; it does not by itself guarantee acceptance or availability. We will notify you if we decline or cancel your order and refund amounts collected for canceled, unfulfilled items as required by law.

We may review or limit orders for suspected fraud, pricing errors, inventory limitations, or unauthorized resale. Restrictions on unauthorized resale do not prohibit purchases by our approved wholesale retailers under their agreed terms.

You agree to provide accurate billing, shipping, contact, and account information and to use an authorized payment method. Payment timing and any deposit or balance requirements will be disclosed during ordering or in separately agreed wholesale terms.

Contact support@stewartsimmons.com promptly to request an order cancellation or address change. We cannot guarantee changes once an order has entered fulfillment or production. This does not limit cancellation or refund rights provided by applicable law.

7. Shipping and Delivery

Our online retail store currently ships within the United States. Available shipping methods, charges, processing information, and any item-specific shipment estimates are disclosed on the Site or during checkout.

Carrier transit estimates generally begin after shipment and are separate from order-processing or production time. Preorders, customized items, and items fulfilled by different suppliers may have different schedules or arrive in separate packages, as disclosed for the order. Any additional shipping charges will be disclosed before they are agreed to.

If tracking is delayed, your package is missing, or an item arrives damaged or incorrect, contact support@stewartsimmons.com so we can investigate and arrange an appropriate resolution. Carrier involvement does not eliminate any responsibility we have under applicable law.

8. Third-Party Services and Supplier Fulfillment

Our store uses Shopify and other providers for payments, customization, fulfillment, and other services. Some products purchased through our checkout are shipped directly by suppliers through Shopify Collective or other fulfillment arrangements.

For questions about an order placed with Stewart Simmons, including supplier-fulfilled items, contact us first at support@stewartsimmons.com. The use of a third-party supplier does not by itself remove your rights against us for your purchase.

Our Site may link to external websites or services. Their separate terms and privacy practices govern your interactions with them. We do not control the content or operation of independent third-party websites.

9. Reviews, Feedback, and Other Submissions

You are responsible for content you submit and must have the rights necessary to share it. Do not submit unlawful, misleading, infringing, or abusive content, confidential information belonging to someone else, or malicious code.

When you submit a review or other content intended for public display on our Site, you grant us a nonexclusive, royalty-free license to host, display, and reproduce that content to operate the relevant Site feature. We may make formatting or length edits that do not materially misrepresent its meaning. You retain ownership of your content. Use of your content in separate advertising campaigns is subject to any additional permission or terms agreed with you.

We may moderate content for legitimate reasons such as unlawful material, spam, privacy violations, or content unrelated to the product or service. We do not prohibit honest reviews or require favorable reviews as a condition of resolving a complaint.

10. Personal Information

Our collection, use, and disclosure of personal information are described in our Privacy Policy. You can access applicable data-sharing opt-out choices through Your Privacy Choices.

11. Errors, Inaccuracies, and Omissions

Information on the Site may occasionally contain errors involving descriptions, prices, promotions, shipping charges, shipping estimates, or availability. We may correct those errors. If a correction affects your order, we will notify you and explain the proposed resolution.

We will not charge a higher corrected price for an order without your agreement. If an affected order is canceled, we will refund amounts paid for the canceled items as required by law. Corrections do not override applicable consumer protections or our obligations regarding shipping delays.

12. Prohibited Uses

You must not use the Site to:

• Violate applicable law or infringe intellectual property, privacy, or other rights.
• Submit fraudulent orders, impersonate another person, or provide materially false information.
• Harass, threaten, abuse, or unlawfully discriminate against others.
• Introduce malware, send spam, attempt unauthorized access, or interfere with security or Site operation.
• Collect other people’s personal information without authorization or unlawfully scrape or exploit Site content.

We may restrict access in response to prohibited activity, subject to applicable law and our obligations concerning existing orders.

13. Service Availability, Warranties, and Liability

We aim to keep the Site available and functioning, but do not promise uninterrupted or error-free access. We may maintain, update, suspend, or discontinue Site features. This does not eliminate our obligations for accepted orders.

To the extent permitted by applicable law, the website and its informational features are provided on an “as available” basis. This statement does not disclaim product warranties or guarantees that we expressly provide, or statutory warranties and consumer rights that cannot lawfully be excluded.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the Site. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other liability to the extent it cannot lawfully be excluded or limited. Any permitted limitation applies only to the extent allowed in your jurisdiction.

14. Responsibility for Misuse

You are responsible for your unlawful use of the Site and for content or instructions you submit that violate the rights of others. Any obligation to compensate us or another party for resulting loss is subject to applicable law. This section does not require you to reimburse us for losses caused by our own unlawful conduct.

15. Severability

If a provision of these Terms is found unlawful or unenforceable, it will be limited or severed to the extent required by law. The remaining provisions will continue to apply to the extent permitted by law.

16. Termination

You may stop using the Site at any time. We may suspend or terminate access for a material breach of these Terms, unlawful activity, or legitimate security reasons, subject to applicable law.

Termination does not cancel rights or obligations arising from earlier transactions, including payment obligations, required refunds, product remedies, or rights that by their nature survive termination.

17. Entire Agreement and Order-Specific Terms

These Terms, the policies they reference, and any additional terms expressly agreed to for a particular order govern your use of the Site and purchases from us. Separately agreed wholesale or order-specific terms control their specific subject matter if they conflict with these general Terms.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later. Nothing in this section excludes representations, promises, or rights that applicable law requires us to honor.

18. Governing Law

These Terms of Service and any separate agreements under which we provide services to you are governed by the laws of the State of Georgia, subject to any mandatory consumer protections that apply under the laws of your place of residence. Nothing in these Terms limits rights that cannot legally be waived.

19. Changes to These Terms

We may update these Terms to reflect changes to our business, services, or legal requirements. We will post the revised version here and update the effective date. We will provide additional notice or obtain agreement where required by applicable law.

Changes apply prospectively and do not retroactively change the agreed terms of an existing order without your agreement, except as permitted or required by law.
